The Defense gave its opening statement to jurors. Jade Janks lead attorney dismissed the State's assertion that she plotted the murder of her stepfather, Tom Merriman. Instead, the Defense argued that he died of drug abuse. No evidence of strangulation and plenty of evidence of drug abuse. The Defense wanted to raise doubt in the prosecution's case against her.

Prosecutors wanted to show how far they believed the former interior designer went to kill her stepfather, Tom Merriman, and dispose of his body. They called to the stand one of the men she was accused of asking to help her. Brian Salomon claimed that Jade Janks wanted to put a pillowcase over her stepfather's head and a rope around his neck. Salomon testified that he ran away from her at one point on the day prosecutors said she killed her stepfather.
